Heard learned counsel for the appellant and counsel for the State.
Paragraph 4 is the finding based on the decision rendered by a Division Bench in L.P.A. No.145 of 2014 (Vijay Kumar Mishra vs. The State of Bihar & Ors.).
The statutory provision, which is in vogue in the State
Patna High Court LPA No.2189 of 2016 dt.07-03-2017 2/2 of Bihar, i.e. Rule 43(c) of the Bihar Pension Rules, does not make it obligatory upon the State authorities to make settlement of final pension and gratuity since, admittedly, the appellant is facing trial in a C.B.I. Court under Prevention of Corruption Act in what is known as the fodder scam.
Till the appellant is exonerated, he cannot claim gratuity as a matter of right.
The learned single Judge has committed no error which requires rectification.
Appeal is dismissed.
