In this case, the petitioner is seeking bail in connection with Sagauli Rail Police Station Case No.13 of 2014 for the offence under Sections 328, 379, 307/34 of the Indian Penal Code.

The fact has been mentioned that the informant was coming along with wife and mother. These persons have accompanied the informant and developed intimacy. In course of journey, they have provided the intoxicated drinks which the informant and other family members could not take. The petitioner was identified from the photograph maintained by the police station.

No.47989 of 2015 (2) dt.02-11-2015 2/2 petitioner, Nanhak @ Chhotu Patel, be released on bail on or after 18th January, 2016 on his furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Bettiah, District- West Champaran in Sagauli P.S. Case No.13 of 2014, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
