2. The present Criminal Miscellaneous petition has been filed for cancellation of provisional bail granted to O.P. No. 2, vide order dated 10.04.2024 passed by this Hon'ble Court in Cr. Misc. No. 25811 of 2024 in connection with Amarpur P.S. Case No. 540 of 2018.

3. Learned counsel for the petitioner submits that vide order dated 10.04.2024 passed in Cr. Misc. No. 25811 of 2024 in para 7 learned Court below was directed to confirm the provisional bail of the petitioner (O.P. No. 2 herein) after satisfying that petitioner (O.P. No. 2) has paid the said amount

Patna High Court CR. MISC. No.8505 of 2025(2) dt.25-11-2025 2/2 i.e. Rs. 5 lakh to the informant within a period of nine months. However, O.P. No. 2 has not paid the said amount to the petitioner. Learned counsel submits that this case may be disposed of with liberty to the petitioner to file petition for cancellation of bail of O.P. No. 2 for non-compliance of para 7 of the said order.

4. Learned A.P.P. for the State has no objection to this prayer of the petitioner.

5. In view of the submission of learned counsel for the petitioner, this case is disposed of with liberty to the petitioner to move petition before the learned Trial Court for noncompliance of the order dated 10.04.2024 by O.P. No. 2 and on filing of such petition by the petitioner within four weeks, the Trial Court shall dispose of the same within a period of eight weeks thereof.
