The petitioner apprehends his arrest in connection with Town P.S. Case No. 293 of 2017, registered for the offences punishable under Sections 409, 420, 467, 468/471 of the Indian Penal Code.

The allegation against the present petitioner is that being a Civil Surgeon, he has ordered for payment of salary to two persons namely Shiv Nandan Mahto and Nand Kishore Pandit whose appointment was found forged and fabricated.

Learned counsel for the petitioner has submitted that the

Patna High Court CR. MISC. No.19519 of 2021(2) dt.22-01-2022 2/2 petitioner has made payment to Shiv Nandan Mahto and Nand Kishore Pandit on the order of the Hon'ble High Court in CWJC No. 11865 of 2014 order dated 20.12.2016 whereby the High Court has directed the petitioner to make payment of salary of co-accused Nand Kishore Pandit.

It appears that the petitioner in compliance of the order of the High Court has granted salary to the accused persons. As such, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, in connection with Town P.S. Case No. 293 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
