The petitioners are languishing in custody for the offence punishable under Section 364/34 of the Indian Penal Code.

Allegation is of kidnapping of nephew of the informant. The victim boy was recovered on the same day. Submission is that in fact the victim had stolen a mobile of petitioner No.1 and just to identify the place of hiding the said mobile he was taken. The petitioners are in custody since 17.11.2018.

Considering the aforesaid fact, let the petitioners,

Patna High Court CR. MISC. No.9801 of 2019(4) dt.30-04-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Phulparash P.S. Case No.255 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
