Petitioner apprehends arrest in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, eight unknown armed accused persons came and committed dacoity and looted cash and mobile sets. They also damaged the laptop and thereafter fled away.

Learned counsel for the petitioner submits that the name of the petitioner has been transpired during the investigation only on the basis of the confessional statement of the co-accused, namely, Mukesh Sahni and Dheeraj Kumar.

Patna High Court CR. MISC. No.8835 of 2023(2) dt.12-05-2023 2/2 Similarly situated co-accused person has already been granted bail by the Co-ordinate Bench of this Hon'ble Court vide order dated 10.07.2019 passed in Cr. Misc. No. 22768 of 2019. The petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Court no.-1(West), Muzaffarpur in connection with Dewaria P.S. Case No. 95 of 2018 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
