Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act. Petitioner is in custody since 17.04.2018. The FIR of the occurrence of dacoity is against unknown. Submission is that petitioner was never put on Test Identification Parade during investigation nor any incriminating article was recovered from his possession. Only suspicion is there and on that basis petitioner was remanded in this case from some other case.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

No.9929 of 2019(3) dt.02-05-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Ladaniya Police Station Case No. 26 of 2016, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
