The petitioner is apprehending arrest in connection with Katihar Town P.S. Case No. 310 of 2019 for offences under Sections 406, 420 IPC and Section 138 N.I. Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The liability of the petitioner towards the informant is Rs. 2,61,000/-. Counsel for the informant submits that the informant is interested in realization of the due amount. Learned counsel for the petitioner submits that the vehicle met with an accident and therefore, the petitioner is in difficulty in payment of the due amount. If the court grants

Considering the aforesaid, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on provisional bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Katihar in connection with Katihar Town P.S. Case No. 310 of 2019 subject to deposit of Rs. 70,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C.

Thereafter, the petitioner shall deposit the remaining amount in three equal monthly instalments within a period of four months from today and on deposit of the entire money i.e. Rs. 2,61,000/-, the court below shall make the provisional bail absolute.
