JUSTICE RAVI RANJAN ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered for offences punishable under Section 414 of the Indian Penal Code and sections 25(1-b)a, 26/35 of the Arms Act.

As per the allegation, the informant, at the time of patrolling duty, received information that the miscreants were committing dacoity and saw that the villagers were chasing the criminals who were on motorcycle. They caught hold them. It is stated that a country made pistol and one cartridge were recovered from the possession of the petitioner and from other co-accused also one country made pistol and a live cartridge were recovered. It is submitted on behalf of the petitioner that co-accused Md. Safdar has been granted bail by a Coordinate Bench of this

Having regard to the facts and circumstances of the case, the petitioner, namely, Md. Jahangir is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Katihar, in Azamnagar P.S. Case No. 212/2013 with a further condition that one of the bailors of the petitioner must be a close relative or family member of the petitioner who shall file affidavit before the concerned court giving complete genealogy to show his / her relationship with him.
