The petitioner seeks bail in a case initially registered under Sections 376, 511, 323, 341, 504/34 of the Indian Penal Code and subsequently, Section-18 of the POCSO Act was also added. Allegation against the petitioner is of attempting to outrage her modesty.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 10-12-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The alleged incident is said to have taken place on 28-08-2018 and the FIR has been instituted

Patna High Court CR. MISC. No.7681 of 2019(5) dt.17-07-2019 2/2 on 16-09-2018. The delay in lodging the FIR has not been explained by the prosecution.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Jamui in connection with Jamui Mahila P.S. Case No. 69 of 2018.
