The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with K Hat (Maranga) P.S. Case no. 886 of 2019 instituted for the offence under Sections 147, 148, 341, 342, 323, 325, 307, 354A, 380, 458 and 506 of the Indian Penal Code. As per allegation in the FIR, petitioner along with other co-accused have entered into the house of the informant after cutting the grill by cutter and have assaulted the family members of the prosecution party and taken away cash and ornaments from the house.

Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.6680 of 2020(5) dt.27-10-2021 2/2 has submitted that petitioners are innocent and have been falsely implicated in this case. They have got no criminal antecedent. Injuries received by the son of the informant are simple in nature. Petitioners are close relatives of divorced daughter-inlaw of the informant. There is inimical terms between the petitioners and the prosecution party and several cases are pending between tehm.

Learned APP has opposed the prayer of bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with K. Hat (Maranga) P.S. Case No. 886 of 2019, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea subject to the conditions as laid down under section 438(2) of the Cr.P.C.
