The petitioner seeks bail in Mashrakh P.S. Case No. 131 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant is not an eye witness of the occurrence. The informant made allegation that the deceased was working as a servant in the house of the petitioner and the petitioner was not paying salary.

Learned counsel for the petitioner submits that no external injury was found on the body of the deceased. There is no allegation that the petitioner assaulted the deceased. The deceased was taken excessive wine.

It appears that some of the witnesses stated that the

Patna High Court Cr.Misc. No.45565 of 2014 (3) dt.30-03-2015 2/2 petitioner used to assault the deceased, but from the post-mortem report it appears that no external injury was found over the body of the deceased.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Mashrakh P.S. Case No. 131 of 2014.
