JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the State. Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite Court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 379, 354, 307 and 34 of the Indian Penal Code. It is submitted that there is case and counter case. Both the parties are agnates. Informant is brother of petitioner no. 1 and son of petitioner no. 2. From the perusal of the

Patna High Court CR. MISC. No.18391 of 2021(2) dt.13-12-2021 2/2 impugned order it appears that the informant received injury on thigh which fractured due to assault, which is not a vital part of the body.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, I, Bhagalpur, in connection with Nathnagar (Madhusudanpur) P.S. Case No. 267 of 2020, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
