JUSTICE RAKESH KUMAR ORAL ORDER 04-02-2015 The petitioner, who is in custody in connection with Lodipur P.S. Case No. 47 of 2014 registered for the offence under Section 302, 201, 120 (B) , 147 , 148 & 149 of the Indian Penal Code, has prayed for grant of bail.
It appears that actual occurrence had not been witnessed by anyone. Only on animosity and some occurrence, which had taken place prior to recovery of the dead body of the deceased, the petitioner along with others have been made accused.
Sri M.K. Kharey, learned A.P.P. has opposed the prayer of bail. He submits that prior to the occurrence, there was some scuffle in between the deceased and petitioner and others and subsequently, for taking revenge, this occurrence had taken place. Keeping in view the fact that none of the persons have

Let the petitioner Luxman Mandal be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Ranjan Raman, Judicial Magistrate 1st Class, Bhagalpur in connection with Lodipur P.S.
