The petitioner is in custody since 21.03.2014 in connection with Arwal P.S. Case No. 65 of 2014 registered for the offences punishable under Sections 370, 370(i), 372,373 of the Indian Penal Code, 6, 8 of the POSCO Act and 3,4,5,7, 8 of the Immoral Traffic Prevention Act.
It is submitted on behalf of the petitioner that the petitioner was taken into custody during the course of the raid conducted by the Dy.S.P, Arwal and it was alleged that the petitioner was active in conducting the flesh trade being run at Janakpur Dham. It is further submitted that though it has been alleged that many of the girls were recovered on raid but subsequently the said girls in the statement under Section 164 Cr.P.C have denied their involvement in any immoral act. No.32776 of 2014 (3) dt.24-12-2014 2/2 further submitted that the petitioner was arrested on mere suspicion and there is no other cogent material in the case diary so as to connect the petitioner with the present case. It is submitted that similarly situated co-accused Nagendra Prasad @ Nagendra Nut has been granted anticipatory bail by a Bench of this Hon'ble Court in Cr. Misc. No. 23740 of 2014 vide order dated 11.09.2014.
Considering the aforementioned submissions and also that there is no other cogent material in the case diary so as to connect the petitioner with the present case, let the petitioner, Kariman @ Ranjan Kumar @ Kariman Paswan be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge I, Jehanabad in connection with Arwal P.S. Case No. 65 of 2014.
