JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Goraul P.S. Case No. 171 of 2019 for offences under Sections 341, 323, 354(A) and 504 of the Indian Penal Code and Section 3/4 of POSCO Act.

Learned counsel for the petitioner with reference to Annexure-2 submits that the informant and the victim have jointly filed a petition before 1st Additional District & Sessions Judge-cum-Special Judge POSCO , Vaishali at Hajipur. Considering the aforesaid, present petition is disposed of with a liberty to the petitioner to surrender before the court below and seek regular bail on the basis of Annexure-2. In the event the petitioner surrenders before the court below and files

Patna High Court CR. MISC. No.6916 of 2020(2) dt.28-02-2020 2/2 an application for grant of regular bail, the court below shall pass an appropriate order considering Annexure-2 on the same day without being prejudiced by the order of rejection of this application.
