====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 16-04-2024 Heard Mr. Santosh Kumar Verma, learned counsel appearing on behalf of the petitioner and Mr. Md. Iftekhar Mahmood, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Forbesganj P.S. Case No. 936 of 2022, registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.

3. As per the allegation made in the FIR, all the accused persons including the petitioner had committed theft of several ornaments by opening lock of Sri Panchmukhi Mahavir Temple.

4. Considering the nature of allegation made in the FIR, as well as, the fact that recovery was made from the house of co-accused, namely, Md. Tanvir, who, in police custody, has

5. The petitioner, if so desires, may surrender before the learned District Court and seek regular bail. The District Court, on the basis of material collected in course of investigation, may pass appropriate order same day.

6. Accordingly, the present bail application is disposed of.
