The petitioner seeks regular bail in connection with Special Case No. 12835 of 2018 arising out of P.R.P.S. (Dhanarua) Case No. 218 of 2018 registered for the offence punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 29.625 litres of illicit liquor from the rented house of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent. The learned counsel for the petitioner has referred to paragraph no. 7 of the petition to state that in reality the room from where

Patna High Court Cr.Misc. No.8241 of 2019(2) dt.13-02-2019 2/2 liquor has been seized, is not rented room of the petitioner herein. Lastly, it is submitted that the petitioner is languishing in custody since 31.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 12835 of 2018 arising out of P.R.P.S. (Dhanarua) Case No. 218 of 2018.
