JUSTICE SATYAVRAT VERMA ORAL ORDER 02-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 354(B), 379, 504, 506 and 34 of the Indian Penal Code. The informant alleges that on 11.02.2021 at about 9:30 pm, while she was coming back after closing her father's shop, she was intercepted by three accused persons, including the petitioner, who started misbehaving and touched her inappropriately to which she objected, it is next alleged that Kaila Singh and Munna both held her and threw her on the ground and tried to sexually assault her but she somehow was able to save herself and disclosed the occurrence to her family members on which her father and uncle went to the house of the

No.8688 of 2022(2) dt.02-09-2022 2/3 accused then it is alleged that they abused and assaulted with lathi and sticks, it is next alleged that Munna Singh and Kaila Singh assaulted informant's uncle with an iron rod on head causing injury and the accused also stole Rs. 10,000/- from informant's father.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and has been falsely implicated in the present case and from perusal of the allegations as alleged in the F.I.R. it would manifest that no specific role has been attributed to the petitioner further the allegations against him is general and omnibus in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Forbesganj P.S. Case No. 112 of 2021 subject to the conditions as laid
