JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Magadh Medical P. S. Case No. 60 of 2019 registered for the offence(s) punishable under Section 30(a)(d) of Bihar Prohibition and Excise Act, 2016.

Allegation is that there is a recovery of liquor from the possession of the co-accused persons and petitioner is also named in F.I.R.

Submission of the learned counsel for the petitioner is that, there is no recovery from the possession of the petitioner or from his house. He is in custody since 27.10.2019 having no criminal antecedent. Charge-sheet has been submitted, as such, there is no change of tampering with the evidence. Heard learned A.P.P. also.

Having heard both sides, in view of the submissions,
