JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Mirganj P.S. Case No. 232 of 2019 registered for the offence(s) punishable under Section(s) 302/120B/34 and Section 27 of Arms Act.
Allegation is that the petitioner is named in F.I.R. and in the F.I.R., it is said that two accused persons, namely, Ashok Singh and Shambhu Singh, both sons of Baliram Singh, riding on the motorcycle shot the brother of the informant causing his death. Petitioner happens to be their mother and earlier threatened the deceased.
Submission of the learned counsel for the petitioner is that she has been made accused in this case only on suspicion as there was land dispute between the parties. She is in custody
Patna High Court CR. MISC. No.6594 of 2020(2) dt.05-02-2020 2/2 since 19.09.2019 and charge-sheet has been submitted. Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail stating that she has earlier threatened the deceased to kill him. Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Gopalganj, in connection with Mirganj P. S. Case No. 232 of 2019.
