ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 17.7.2014 in Suppl. Kasba P.S. Case No.166 of 2013 for the offences under Sections 457, 380 and 411/34 of the I.P.C.

It is submitted on behalf of the petitioner that he is not named in the F.I.R. rather his name surfaced on the basis of the confessional statement of co-accused Kundan Chauhan in K.Hat P.S. Case No.511/14 who has already been granted bail by the learned court below. It is further submitted that nothing has been recovered from the possession of the petitioner rather the stolen articles were seized from his shop. Test identification parade of the articles so seized has not been held till date.

No.46273 of 2014 (3) dt.16-02-2015 2/2 Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Vijay Kumar, J.M., 1st Class, Purnia, in Supplementary Kasba P.S. Case No.166/13.
