JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Excise Case No.184 of 2019, registered under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2018.
There is recovery of 80 litres country made wine. Petitioner is also an accused in one more case. Submission of learned counsel for the petitioner is that the petitioner is innocent and has not committed any offence rather he has been falsely implicated in this case and he is in custody since 04.01.2020.
Heard learned APP also.
In view of the above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of
Patna High Court CR. MISC. No.7312 of 2020(2) dt.24-02-2020 2/2 the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge Excise, Rohtas at Sasaram in connection with Excise Case No.184 of 2019, with condition after release he will cooperate in disposal of trial and make himself available as and when required by the trial court, falling which the prosecution will be at liberty to move for cancellation of his bail bonds.
