2. The petitioner's selection as Anganwadi Sevika has been cancelled on two grounds by the Commissioner. Ground

2/5 No. 1 is that she was having the requisite educational qualification in the 3rd division whereas, the private respondent was having the educational qualification in 2nd division. Inferior educational qualification is one of the grounds for cancelling the petitioner's selection. The other ground is that she was not a resident of the Poshak Kshetra as per her application wherein, she claimed to be resident of tiger tola.

3. The Learned counsel for the petitioner submits that the selection process is of 2004. At the relevant time, the selection was to be guided by two letters issued by the I.C.D.S, namely, letter dated 13.06.1998 bearing no. 1129 and 10.12.2003, bearing no. 1662. It is submitted that if these two letters are to be seen, then it would become apparent that at the relevant time the Aam Sabha was vested with the discretion to make selections considering the worthiness of the candidate. There was no express requirement of having a better educational qualification or residing in the Poshak Kshetra.

4. The submission advanced on the basis of these two letters appears to be incorrect from bare perusal of the letters itself. The clause 5(1) of letter dated 13.06.1998 bearing no. 1129, reads as follows:- "आँगनबबाडड़ी सेवविकबा कड़ी न्यूनतम शैक्षवणिक ययोग्यतबा प्रविसेवशकबा उतड़ीणिर्ण हशै। वसर्ण अनुसयूवचित जबावत /

3/5 अनुसयूवचित जनजबावत कड़ी सेवविकबाओं कसे वलिए न्यूतम ययोग्यतबा प्रविसेवशकबा अनुतड़ीणिर्ण हशै। परन्तनु सनुययोग्य शसेणिड़ी कड़ी अवधिकतम शैक्षवणिक ययोग्यतबा विबालिसे उम्मड़ीदविबार कयो प्रबाथवमकतबा दड़ी जबायगड़ी। परन्तनु जहहाँ वजलिबा पदबावधिकबारड़ी / उप वविकबास आयनुक्त यह महसयूस करें वक अपविबाद स्विरूप वकसड़ी मबामलिसे मसे लिबाभबावन्वित विगर्ण कड़ी वनधिर्धावरत शैक्षवणिक ययोग्यतबा कड़ी मवहलिबा नहहीं वमलि रहड़ी ह, तयो उस वस्थवत मरें वनदसेशक समबाज कल्यबाणि कबा वलिवखित आदसेश प्रबाप्त कर शैक्षवणिक ययोग्यतबा मरें छयूट लिड़ी जबायसेगड़ी।"

5. From bare perusal of extract of the two letters relied upon by the petitioner it is obvious that requirement of better qualification and being resident of the Poshak Kshetra was the requirement at the time selection was done.

6. The submissions advanced by the petitioner's counsel are, thus, baseless.

7. No case is made out for interfering with the order dated 28.10.2009 whereby petitioner's selection was cancelled.

8. The writ petition is dismissed.
