JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364 and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping son of the informant.

It has been submitted on behalf of the petitioner that he has been in custody since 21.3.2015. Chargesheet has been submitted in this case. There is no allegation of tampering with the evidence. Statement of the victim boy has been recorded under Section 164 of the Code of Criminal Procedure in which he has not named this petitioner. Other co-accused have been granted bail vide Cr. Misc. no. 35556 of 2015, Cr. Misc. no. 25919 of 2015 and Cr. Misc. no. 32213 of 2015.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. and his name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the

No.33329 of 2015 (3) dt.05-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar V, learned Judicial Magistrate, Ist Class, Patna City, Patna, in connection with Gaurichak P.S. Case no. 39 of 2015.
