JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 364A/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping son of the informant.

It has been submitted on behalf of the petitioner that he has been in custody since 20.5.2014. Chargesheet has been submitted in this case. There is no allegation of tampering with the evidence. The victim has been examined under Section 164 of the Code of Criminal Procedure in which name of the petitioner has not been mentioned. There is no direct or indirect evidence to suggest implication of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. His name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
