2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 149, 323, 384, 386, 419, 420, 506, 504, 307, 364, 120B of the Indian Penal Code and therefore, the cognizance has been taken under Sections 420, 342/34 of the Indian Penal Code.

3. It is alleged that this petitioner along with other coaccused persons took seven lakh rupees in cash cash from the complainant for providing government job to son of the informant but did not provide the job and thus cheated the complainant.

4. It is submitted that no money as alleged was ever paid to the petitioner. Complainant voluntarily parted with the alleged amount for an illegal purpose of getting job in the Government sector through unfair means which itself is unlawful, as such , he cannot be allowed to urge that he has been cheated. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II Bhagalpur in connection with Complain Case No. 379 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
