Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 394 and 302 of the Indian Penal Code.
The prosecution case, in short is that on 30.08.2021 at about 04:00 am husband and son of the informant were going to Siwan Junction for catching train, her son returned at 05:00 am by tempo at about 06:00 am, she got information that near Reliance Digital at Babunia Station Road, her husband is lying dead, someone had killed by stabbing.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.8767 of 2022(2) dt.13-07-2022 2/2 petitioner is innocent and his name surfaced in this case on the basis of confessional statement of another co-accused namely, Taufique Alam. Further, it is submitted that no any eye-witness of the occurrence and no incriminating articles have been recovered from the possession of the petitioner. The petitioner is in custody since 01.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Siwan Town P.S. Case No. 455 of 2021. (Khatim Reza, J) annpurna/- U T
