This application for grant of regular bail arises out of Rajpur Police Station Case No. 119 of 2022 registered for the offence under Sections 147, 148, 149, 302, 337, 338 and 504 of I.P.C. and under Section 37 of Bihar Prohibition & Excise Act, 2022.
As per the F.I.R., allegation against the accused persons including the petitioner is that they have assaulted the husband of the informant with different weapons. As a result of which, the husband of the informant sustained serious injuries and during the course of the treatment he succumbed to his injuries.
As per the prosecution case, the co-accused Rajesh Paswan is the main assailant of the deceased. There are general
Patna High Court CR. MISC. No.8117 of 2023(2) dt.03-05-2023 2/2 omnibus against the petitioner. The petitioner has clean antecedent. He is in custody since 03.01.2023. Considering the aforesaid facts, this application is allowed.
Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 2 cum Additional District and Sessions Judge, Rohtas at Sasaram, in connection with Rajpur Police Station Case No. 119 of 2022. This is also subject to the condition that the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
