The petitioner seeks bail in a case under Sections 302 and other allied sections of the Indian Penal Code. Reshma Devi, the informant named ten persons including the petitioner Surendra Sahni and alleged that while her father-in-law and mother-in-law had gone to work in the field, she got information that the accused persons were quarreling with them. Thereafter her father-in-law and mother-in-law did return and their dead bodies were recovered on the next day. It is submitted that petitioner is named in the First Information Report but except suspicion, there is no material. Co-accused Bal Kishun Sahani, Ashok Sahani, Shiv Kumar Sahani and Ram Briksh Sahani @ Ramvikash Sahni

Patna High Court Cr.Misc. No.45165 of 2014 (2) dt.23-02-2015 2 / 2 have already been enlarged on anticipatory bail vide orders passed in Cr. Misc. No. 29183 of 2013 and Cr. Misc. No. 26877 of 2013 respectively. It is further submitted that the case of the petitioner stands on similar footing and he is in jail since 25.08.2014. Considering the facts that the name of the petitioner is suspected in killing of the father-in-law and mother-in-law of the informant but there is no eye witness to the occurrence and similarly situated co-accused persons have already been enlarged on anticipatory bail, petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S.
