Petitioner is in custody in connection with Rail P.S. Bakhtiyarpur (Barh) (G.R.P. Bakhtiyarpur Barh) Case No. 127 of 2019 for the offence under sections 323, 324, 325, 341, 342, 307, 379, 504, 506, 326 and 34 of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel for the petitioner would submit that petitioner and other were riding on a motorcycle, sprayed dirty water over the body of the informant and on being objected, the petitioner and others variously armed abused and assaulted the informant.

The injury report which is enclosed as Annexure-2

Patna High Court CR. MISC. No.12873 of 2020(2) dt.05-06-2020 2/2 indicates that the injury found on the informant is simple in nature.

The petitioner is in custody since 13.11.2019. Considering the nature of injury sustained by the informant, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna, in connection with Rail P.S. Bakhtiyarpur (Barh) (G.R.P. Bakhtiyarpur Barh) Case No. 127 of 2019 (having G.R. No. 514 of 2019) subject to the condition that on release the petitioner has to render his service as volunteer in Covid-19 hospital for a period of one month to combat Covid-19 and he is required to report to the district Civil Surgeon/Nodal Officer who shall utilize the service of the petitioner appropriately.
