The petitioner, who is languishing in custody, seeks bail in a case registered under sections 363 and 366 of the Indian Penal Code, is solitary named accused in this case with allegation of taking away daughter of the informant with ulterior motive and the victim, on recovery, though has said nothing about any wrong (physical committed with her) but states about forceful marriage with the petitioner in spite of the fact that a month and half before she had already been married with another person.
Having regard to the facts and circumstances of the case, the petitioner appears not entitled for the privilege sought. Accordingly, his prayer for regular bail in connection with Digha P.S. Case No.151 of 2014,pending in the court of
Patna High Court Cr.Misc. No.45319 of 2014 (3) dt.27-02-2015 2/2 learned Judicial Magistrate, Patna, is hereby refused. Simultaneously, the court below is directed to proceed expeditiously with the trial and avoid undue delay and adjournments.
