The petitioner is seeking anticipatory bail in connection with Special Case No. 9051/2017 arising out of Fatuha P.S. Case No. 553/2017 registered under Sections 30(a), 38 of the Bihar Prohibition & Excise Act, 2016 and 120-B of the Indian Penal Code pending in the court of learned Special Court, Excise Act, Patna.

Since there is a recovery of illicit liquor from the house of the petitioner, this court is not willing to extend the benefit of anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is refused.
