JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Sonepur P.S. Case No. 458 of 2014, disclosing offences under Sections 302/34 of the Indian Penal Code.
Petitioner is the husband of the deceased and is in custody since 13.10.2014. It is submitted on behalf of the petitioner that his implication is based on mere suspicion who lived in Punjab to earn his livelihood, in a plywood factory. He has submitted that even in course of investigation, no eye witness has suggested petitioner's involvement in commission of crime. In view of the submission as above, this application is allowed. Let petitioner above named be released on bail on
Patna High Court Cr.Misc. No.47411 of 2015 (2) dt.27-10-2015 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Chapra at Saran in Sonepur P.S. Case No. 458 of 2015.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled (Chakradhari Sharan Singh, J) ArunKumar/- U
