The petitioner apprehends his arrest in Agiaon Bazar P.S. Case No.88 of 2018 registered under Sections 30 (a) and 38 of the Bihar Prohibition and Excise Act.

On the basis of secret information that liquor was kept in a house, for selling, situated at Agiaon market, the police raided the house of Krishna Sah from where Krishna Sah and Santosh Sah were apprehended. The petitioner and other two accused persons are alleged to have fled away. Learned counsel for the petitioner submits that the recovery of liquor was made from the house of Krishna Sah. Nothing has been recovered from possession of the petitioner. The petitioner had visited the house of Krishna Sah for his

Patna High Court Cr.Misc. No.9635 of 2019(2) dt.19-02-2019 2/2 personal talk but this fact does not show that the petitioner was also indulged in selling liquor recovered from the house of Krishna Sah.

Having considered the fact that the liquor was recovered from the house of Krishna Sah, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur at Ara in connection with Agiaon Bazar P.S. Case No.88 of 2018 (Excise Case No.1281 of 2018), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U
