2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 385 and 387 of the Indian Penal Code.

3. The case of the prosecution is that 10-15 persons were arrived and obstructed the men of the informant who were engaged in road construction work and also demanded a levy. It is further alleged that they were also threatened with dire consequences.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the name of the petitioner is not named in the FIR. It is further submitted that he was apprehend in connection with Gurua P.S. Case No. 232 of 2025 wherein he is alleged to have made a confessional statement stating that he was involved in the

Patna High Court CR. MISC. No.7587 of 2026(2) dt.06-02-2026 2/2 occurrence. Save and except the said confessional statement, there is no material on record to implicate the petitioner. It is further submitted that there is only an allegation of demand of levy but no levy was actually paid and leaflet is annexed as the part of the FIR. It is further contended that similarly situated coaccused, namely, Ranjan Kumar @ Ravindra Yadav @ Ravindra Kumar has already been granted bail vide order dated 15.01.2026 passed in Cr. Misc. No. 89840 of 2025. Moreover, the petitioner is languishing in judicial custody since 18.07.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Amas P.S. Case No. 407 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati at Gaya.
