====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case for the offence registered under Sections 304(B) and 201/34 of the IPC. The prosecution story, in brief, is that the informant's niece Rekha Devi was married with one Sonu Paswan (petitioner) with Hindu customs and rituals about three years also. Parents of Rekha Devi has gifted jewellery, a motorcycle and cash rupees 1,00,000/- to this petitioner. After marriage, informant's niece went her Sasural and spent sometime happily there. But after passing sometime, all the accused persons named in the F.I.R. in conspiracy with other unknown persons killed Rekha Devi for demand of dowry.
Patna High Court CR. MISC. No.11580 of 2020(2) dt.28-02-2020 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 20.06.2019. The petitioner has got no criminal antecedent. He has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. There is no eye witness to the alleged occurrence. A petition has been filed before the learned Chief Judicial Magistrate, Vaishali at Hajipur and before the Superintendent of Police, Vaishali at Hajipur where the informant has retracted from his earlier statement vide Annexures-3 and 4 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Vaishali at Hajipur, in connection with Vaishali (Belsar O.P.) P.S. Case No. 229 of 2019.
