ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 27.08.2015 in connection with Sahpur P.S. Case No. 57 of 2015, registered for offences punishable under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is languishing in jail custody in connection with theft of a motorcycle, however, the same has not been recovered from the possession of the petitioner. It is further submitted that the name of the petitioner has transpired only on the basis of confessional statement made by a co-accused, namely, Bikesh Sharma. Learned counsel for the State after referring several paragraphs of the case diary also submitted that save and except

Considering the aforementioned facts and circumstances, the period of custody and also that the name of the petitioner has surfaced only on the basis of confessional statement made by the co-accused, Bikesh Sharma, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrat, Bhojpur, Ara, in connection with Sahpur P.S. Case No. 57 of 2015. .
