JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Khagaria (Gangaur) P.S. Case No. 654 of 2019, G.R. No. 2499 of 2019, registered for the offences punishable under Sections 302 and 34 of Indian Penal Code and 27 of Arms Act. Allegation is that, petitioner is said to have fired on deceased causing his death.

Submission of the learned counsel for the petitioner is that since the incident happened in the night so that the identification of the petitioner is doubtful. He is in custody for 5 months.

Heard learned A.P.P. who has opposed the prayer for bail stating that there is direct allegation against the petitioner of causing firearm injury to the deceased and the impugned order shows that the post mortem report also supports the prosecution
