JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 498-A and other Sections of the Indian Penal Code.

As per the prosecution story, there is complicity of the petitioner in the alleged offence of murder of his wife Reena Kumari ( the deceased).

It has been submitted of behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner is in custody since 07.03.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence. The independent witneses who have been examined in Paragraph No.

Patna High Court Cr.Misc. No.33387 of 2015 (3) dt.05-10-2015 P2/2 11, 12, 13 and 14 of the case diary, they have stated that there was a dispute between the petitioner and the deceased in relation to some purchase of Sari and subsequently, the deceased went and jumped from the terrace of the house. The independent witnesses are none other but the tenants of the same house. It has been submitted on behalf of the State that petitioner is named in the First Information Report and is the husband of the deceased.

Considering the aforesaid facts and circumstances, the petitioner above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Patna City, Patna in connection with Khajekalan P.S. Case No. 43/2015.
