The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

As per the prosecution story, the petitioner alongwith others, is alleged to have set the deceased on fire by pouring kerosene oil who died during course of his treatment. It has been submitted of behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner is in custody since 23.02.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence. Petition is Sarhu of the deceased. There is no specific allegation

Patna High Court Cr.Misc. No.33582 of 2015 (3) dt.05-10-2015 P2/2 against him. There is no eye-witness to the occurrence. The other co-accused have been granted bail vide Cr. Misc. No. 5703 of 2015.

It has been submitted on behalf of the State that petitioner is named in the First Information Report. Considering the aforesaid facts and circumstances, the petitioner above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Nawada in connection with Pakaribarawan P.S. Case No. 243/2014.
