The petitioner is an accused in as case under section 307,379 and other allied sections of the IPC and section 27 of the Arms Act.
The informant alleged that the petitioner along with others ransacked his house. It is further alleged that the petitioner and one Sanjay Rai fired hitting leg of his son, Pankaj Kumar.
Learned counsel for the petitioner submits that there is a case and a counter case and the injury sustained by Pankaj Kumar was found to be not caused by fire arms. The other side opposed the prayer for bail.
In the facts of the case, let the petitioner as mentioned above, be released on bail on furnishing cash surety of
Patna High Court Cr.Misc. No.47526 of 2014 (2) dt.03-03-2015 2/2 Rs.7000/-with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra at Saran in Sonpur Police station Case No. 354 of 2014.
The petitioner will not be physically absent for two consecutive dates at a stretch till three witnesses are examined in the trial.
