1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Basnahi P.S. Case No. 186 / 2024 dt: 13.09.2024 registered under section 137(2), 96, 3(5) of the B.N.S. 2023.
3. As per the F.I.R. the informant alleges that on 11.09.2024 at around 11:00 A.M. he dropped her minor daughter namely Silki Kumari aged about 16 years studying in 10th class at Panchlakh High School and returned home. When he went to school at 04:00 P.M. to receive his daughter after dismissal of classes she was not found there. On search, he received information that the petitioner - Suman Kumar with the assistance of his uncle has kidnapped his daughter.
4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged. No
Patna High Court CR. MISC. No.8542 of 2025(3) dt.14-05-2025 2/2 specific overt act has been attributed against the petitioner rather general and omnibus allegation has been made against the petitioner. During course of investigation police did not find any direct or indirect evidence against the petitioner which could precisely connect him with the alleged offence in question. The petitioner has no criminal antecedent.

Regarding being had to the submission made by the parties, taking into consideration the fact that in paragraph - 33 of the case diary it has come that the victim in her statement recorded u/s 183 B.NS.S. has stated that the petitioner - Suman Kumar came to her school and told her to come with him on the motorcycle and he would drop her to her house but the accused took her to his uncle's house at Patna; the victim is minor and investigation in the case is still going on, as such, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
