JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-09-2022 The present writ petition has been filed seeking the following relief:- "1(i). That the respondent no. 4 be directed to remove the illegal encroachment construction by the villagers over the public road situated in Mauza-Karian, Thana-43, Khata-739(Old), Khesra-848 (old) as same new Khata2855 and new Khesra-2071 than under Anchal-Shivajinagar, District-amastipur."

The learned counsel for the Respondent-State has filed a counter affidavit, which is taken on record wherein it has been stated that an

Patna High Court CWJC No.7868 of 2021(2) dt.22-09-2022 2/2 encroachment case bearing Encroachment Case No. 9/2021-2022, has been initiated by the Circle Officer, Shivajinagar, District-Samastipur i.e. the Respondent No. 4.

In such view of the matter, the Respondent No. 4 is directed to conclude the proceedings of the aforesaid encroachment case by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of twelve weeks from today.

The writ petition stands disposed off on the aforesaid terms.
