Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in Sarairanjan (Ghataho O.P) P.S. Case no. 141/2021 registered for the offence punishable under Section 366A of the Indian Penal Code. The main allegation against the petitioner is that he kidnapped informant's minor daughter with an intention to marry her.

The main submissions advanced by learned counsel for the petitioner are that, in fact, victim, who was about to attend

No.7882 of 2022(2) dt.23-06-2022 2/3 the age of majority at the time of commission of the alleged offence, eloped herself with the petitioner according to her own free will and later on, she and the petitioner appeared before the police and said victim accepted her love affairs with the petitioner before the police and she also recorded her statement before the Judicial Magistrate in which she accepted her physical relationship with this petitioner. Further submission is that petitioner has been languishing in jail since 14.9.2021 and the charge has been framed.

Learned APP has opposed the prayer for bail.

Heard both sides and perused the FIR. Informant's daughter who is stated to be victim has been recovered and the petitioner is facing trial and the charge has been framed. Considering these facts as well as above submissions, stage of the petitioner's case, his clean antecedent as mentioned in para 3 of the petition, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate III, Samastipur in Sarairanjan (Ghataho O.P) P.S. Case no. 141/2021.
