The present matter has been taken out of turn as per the mentioning made by the learned counsel for the petitioner stating therein that the present writ petition may be disposed of with a liberty given to the petitioner to move before the appropriate forum and avail remedy under Section 3G(5) of the National Highways Act, 1956.

It goes without saying that if the petitioner approaches the appropriate forum for redressal of his grievance,
Patna High Court CWJC No.5810 of 2021(3) dt.19-08-2024 2/2 the same shall be considered taking into consideration the fact that the petitioner was pursuing the matter before this Court under Article 226 of the Constitution of India, since the matter was pending since 2021.

In view of the aforesaid, the writ petition is disposed of with a direction given to the petitioner to approach the competent authority as prescribed under Section 3G(5) of the National Highways Act, 1956.

Accordingly, with the aforesaid direction, the writ petition stands disposed of.
