The petitioners seek bail in a case registered for the offences punishable under Section 25(1-b)A,26 and 35 of the Arms Act.
As per the prosecution story, the petitioners were caught with arms while they were fleeing after seeing the Police. It has been submitted of behalf of the petitioners that the petitioners are in custody since 08.05.2015. Chargesheet has been submitted in the present case. From the possession of the petitioner No. 1, one loaded country-made pistol alongwith three cartridges and from the possession of petitioner No. 2, three cartridges are said to have been recovered.
Patna High Court Cr.Misc. No.33838 of 2015 (3) dt.05-10-2015 P2/2 It is further submitted that the petitioners may be released after completion of six months in custody from 08.05.2015. It has been submitted on behalf of the State that petitioners are named in the First Information Report.
Considering the aforesaid facts and circumstances, it is directed that the petitioners may be released after completion of six months in custody from 08.05.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Shivnarayanpur (Kahalgaon) P.S. Case No. 167/2015.
