JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

As per the prosecution story, the petitioner is alleged to have set the sister of the informant (deceased) on fire by sprinkling kerosene oil who died during her treatment at Patna Medical College and Hospital, Patna.

It has been submitted of behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner is in custody since 15.04.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence. The alleged date of occurrence is 12.07.2013 but the fardbeyan was

Patna High Court Cr.Misc. No.33840 of 2015 (3) dt.05-10-2015 P2/2 recorded by the Police on 20.07.2013 for which no plausible explanation is furnished on behalf of the prosecution. Subsequently, in course of investigation charge-sheet has been submitted for the offence punishable under Section 306. The occurrence is said to have taken place in her Naiher. It has been submitted on behalf of the State and on behalf of learned counsel for the informant that petitioner is named in the First Information Report.

Considering the aforesaid facts and circumstances, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 86/2013.
