JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioners and Shri Ashok Kumar, the learned A.P.P. appearing for the State. The petitioners apprehend their arrest in connection with Siwan Town P.S. Case No. 608 of 2019 for the offence punishable under Sections 341, 326, 307, 504, 506, 34 and 304(B) of the Indian Penal Code.
The case of the prosecution in brief is that on 21.10.2019 at about 1 P.M. afternoon, the informant namely

No.8407 of 2020(3) dt.23-06-2020 2/3 Jinat Khatoon was preparing food in the house when the petitioners herein came there and started abusing her and on protest, both the petitioners collectively pushed the informant, resulting in her falling on the burning stove, whereupon the clothes of the informant caught fire, however, on an alarm being raised, the husband of the complainant arrived there, saved the informant from the fire and took her to the hospital, where she is being treated.
The learned counsel for the petitioners has submitted that the the petitioners are sister-in-law and motherin-law of the victim lady, have been falsely implicated in the present case and are having a clean antecedent. It is further submitted that the petitioners have got no complicity in the matter.
The learned A.P.P. appearing for the State has vehemently opposed the prayer for anticipatory bail. Considering the fact that the informant has died subsequently during the course of treatment on account of burn injuries received by her on account of the petitioners having pushed her on the burning stove, resulting in her clothes catching fire, I do not find the present case to be a fit case for grant of anticipatory bail to the petitioners herein, especially in

No.8407 of 2020(3) dt.23-06-2020 3/3 view of the grievous nature of the allegations levelled against the petitioners and the nature of the crime alleged to have been committed by them, resulting in death of the deceased victim lady, hence the present petition stands dismissed, being bereft of any merit.
