The petitioner apprehends his arrest in connection with Kadamkuan P.S. Case No. 312 of 2016 registered under Sections 326 and 307 of the I.P.C. pending in the Court of J.M., 1st Class, Patna.
The petitioner gave several knife blows at the informant due to illicit relation of his wife. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and the allegation of assault by means of knife is totally baseless. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission
Patna High Court Cr.Misc. No.51465 of 2016 (6) dt.27-02-2017 2/2 that petitioner is named in the F.I.R. and there is specific allegation against the petitioner in the case diary. The doctor has also found five injuries on the body of the informant. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
